CFTC Proposes Subjecting Cash Bitcoin Purchases to Futures Rules If Financing Is Offered

The Commodity Futures Trading Commission has issued an advance notice of proposed rulemaking indicating cash Bitcoin purchases may face futures regulatory oversight if financing was offered, even if the buyer paid in full and declined borrowing. Under Section 2(c)(2)(D) of the Commodity Exchange Act, retail commodity transactions with financing offers must trade on designated contract markets unless actual delivery occurs within 28 days. The CFTC clarified that exchange internal ledger entries do not meet the delivery exception without meaningful control, such as private key access. Public comments remain open through Dec. 14.
