The Senate Banking Committee narrowly advanced the Digital Asset Market Clarity Act in a 15-9 bipartisan vote, but a last-minute amendment has raised regulatory risk for decentralized finance. While the Blockchain Regulatory Certainty Act (BRCA) shielding non-controlling developers from money-transmitter treatment survived, the tweak could allow the SEC and Treasury to classify developers or governance-token holders as "securities intermediaries" if they are deemed to be "acting pursuant to an agreement, arrangement, or understanding." That broader leeway increases legal and compliance uncertainty for DeFi projects and could chill development or push activity offshore, even as the bill’s momentum improves the chances of broader market-structure clarity.
